Employment Advice

If you believe you have had a rough deal at work, Wyre Forest CAB can help you exercise your rights.

We offer a range of services regarding employment, from providing accurate information on your rights and responsibilities, to helping you prepare a case for an Employment Tribunal.

Common Complaints

Unpaid Wages

A common complaint is where an employer withholds wages when an employee leaves. This is unlawful and we can help you get your money back.

Sometimes all it takes is a letter from the bureau, other times you may need to go to an Employment Tribunal. If an employer has become insolvent, we can help you get back any money owed via the National Insurance Fund.

Dismissal Due To Pregnancy

It's unlawful for an employer to dismiss a woman because she's pregnant. If proven, this is discrimination on the grounds of sex.

Last year Wyre Forest CAB successfully helped a number of women bring sexual discrimination cases against former employers.

Employment Tribunals

It is unusual for a case to go all the way to a tribunal. Often ACAS will become involved and we can negotiate with them to ensure that you get a fair settlement.

If a case does go to a tribunal, we wouldn't typically attend it with you because of limited resources, but we will do everything we can to help you prepare a convincing case beforehand.

Note that to take a case to a tribunal you will usually need a least one year's service before you were dismissed.

Before considering taking an employer to a tribunal, please bear in mind that the process can be a painful one. For example:

· We can't always get you your job back
· It's unlikely that you'll get an apology
· The tribunal can't usually give the employer any punishment
· You may not get a reference
· It won't stop the employer from doing it again
· You'll probably not get “justice”
· An employment tribunal can take several months
· Your ex-employer may say uncomfortable things about you to justify their decision

If you'd like employment advice, please talk to an adviser and we will do what we can to help.
